MEETING MINUTES
January 3, 2012
1. CALL TO ORDER AND ROLL CALL:
Ryan Simonscalled the meeting to order at 7:00pm. Other members present: Kim Jedlicka, Frank Jones, Brad Cook, Don Hummel, Bob Nieuwenhuis, and John Pelletier. Ryan Simons declared a quorum present for doing business. Other staff members present were John Olson, Jerry Edwards, Atty David Rasmussen, and Town Engineer Mark Kolczaski.
2. COMMUNICATIONS:
A letter from Julie Olson supporting the variance request from Hehr was referenced.
3. COMMENTS AND SUGGESTIONS OF CITIZENS PRESENT REGARDING ITEMS ON THE AGENDA:
None
4. APPROVAL OF THE DECEMBER 6, 2011 MINUTES:
Motion by Nieuwenhuis and seconded by Jones to approve the minutes. All ayes, motion carried 7-0.
5. DISCUSSION/POSSIBLE ACTION ON THE APPLICATION OF ROBERT HEHR, 4155 FINCH LANE, (FHO 00017) FOR SEVERAL SETBACK VARIANCES TO KEEP THE EXISTING LOCATIONS OF THE HOUSE AND GARAGE:
Due to an updated survey and an apparent error in previously granting a Zoning Permit, the house and garage need several setback variances to keep their existing location. Specifically, the house needs .54’ and 1.16’ street yard setback variances. And the garage variance needs include a 4.87’ street yard setback, 15.64’ rear yard setback, and a 1.67’ side yard setback. Motion by Nieuwenhuis and seconded by Hummel to recommend granting the requested variances. All ayes, motion carried 7-0.
6. DISCUSSION/POSSIBLE ACTION ON THE APPLICATION OF THE LAKE DELAVAN PROPERTY COMPANY LLC, (SHODEEN) FOR A CONDITIONAL USE PERMIT DUE TO A CONSERVATION SUBDIVISION AND REZONING PORTIONS OF R-2 ZONING TO R-3 AND R-5A TO ALLOW A MULTI-FAMILY OPTION:
Shodeen has revised their previous plan for The Shores of Delavan Lake Subdivision to allow more green space and offer a multi-family option allowing the total residential unit count to remain the same at 623 and increasing the variety of lot sizes. Mark Kolczaski briefly discussed his engineering review letter suggesting alternative street names be considered and the traffic impact analysis be updated to reflect the increased density of residential units due to multi-family housing near Mound Rd. Citizen comments: Donna Hopkins and Kevin Kiekhafer questioned street width and public access to the wetland areas. Don Deichsel questioned lot sizes the possibility of dividing lots to sell in the future. Fire Chief Edwards recommended providing emergency access at the end of Valencia Dr.to the subdivision and dry hydrants located in the wet detention ponds for better fire protection. Frank Jones expressed concerns that the ratio of multi-family to single family housing greatly exceeds the 15% recommendation in our Comprehensive Plan. Motion by Simons and seconded by Jones to recommend the Conditional Use Permit (conditions attached) and the rezoning of portions of R-2 Zoning to R-3 and R-5A Zoning to allow the multi-family housing. All ayes, motion carried 7-0.
