MINUTES OF SPECIAL MEETING
April 12, 2007
The Special Meeting of the Town of Delavan was held on Thursday April
12, 2006 in the Community Park Building after due notice had been
posted.

Call to order by Town Clerk

Nomination of Chairman for Meeting Only
A motion was made by Jim Wolfgram to appoint Wayne Polzin as acting
Town Chairman
Seconded by Kay Franzen

“Aye”
Bill Endisch asked is this for a temporary Town chairman? Yes,
“Aye”
Chairman Polzin elected pro temp 3-2
Comments and Suggestions of citizens present
Larry Malsch, 417 Fist Street Delavan Inlet, to the town board and
citizens here tonight: At the annual meeting on Tuesday there was a
motion made to have election for town chairman, and I would hope that
the town board supports that. However, Wayne Polzin wrote that was in
the March 8 Enterprise: “To the elected politicians of Walworth
County and surrounding area better start listening to the people that
put them in office you are elected to represent the people.” The
people did vote and recommend that you have an election. Under new
business you had the resignation of the Chairman but he did not resign
and Bill Endisch is not resigning until the April 30th, so I would not
think that you would act on that until May 3rd. meeting. Then you
have appointment for the committee chair persons. I do not know who
made the recommendation for these but, you also usually appoint them
at the April meeting on Tuesday and the board would recommend the
attorney, assessor, depository newspaper and other committees I do not
know how that got on the agenda some how. Thank You
Nancy Coglianese, 1629 Cedar Point Dr, if vacancies open on the board
she would like to recommend Larry Malsch and Dolores Nowak the
incumbents. Just like Mr. Pelletier was kind enough to appoint Mr.
Polzin, it may be something that you would like to consider. Thank
you.
OLD BUSINESS: None
NEW BUSINESS:
Discussion/possible action regarding acceptance of Town Chairman and
Town Board member resignations.
Wayne Polzin stated, "First of all there is no resignation of the
Chairman John Pelletier, he did not accept office, he had 5 days to
accept and did not, so therefore he does not have to turn in a letter
of resignation for that particular reason.
And as far as a resignation for Bill Endisch, he has turned in a
resignation effective April 30, 2007. Wayne Polzin made a motion to
accept his resignation, effective April 30, 2007. 2nd by Jim Wolfgram
Discussion – None, all in favor - unanimous decision, Opposed None,
Motion carried to accept resignation of Bill Endisch.
Discussion/possible action regarding appointment of pro-temporarily
or appointment of Town Chairman
Motion was made by Jim Wolfgram to appoint acting Town Chair Wayne
Polzin as Town Chairman position, 2nd by Kay Franzen
Discussion
Bill Endish asked, “Are you saying that this is to permanently
appoint you as town chairman or as temporary until special election or
whatever the board decides.”
Wayne, “No this is permanent.”
Bill Endisch stated, “I guess going along with what was said at the
meeting last week the vote was 3 -2 that they wanted to have a special
election for the town chairman. I feel that again you talked about
everything else that the people want but, the people wanted “that.”
That is my feeling it should be held at special election.”
Wayne Stated “You cannot run for 6 months without a town chairman.
We have too many irons in the fire at this time that have to be taken
care of the town has to move on. I do not believe it is proper or
best interest in the town of Delavan to take and appoint a temporary
chair at every meeting. No one knows what is going on or what is
going to happen, we have very important things in the works right now
and part is the negotiations with the City of Delavan, Lake Project,
Inlet, Brown’s Channel, Special assessments to those residents from
the dredging of the channel. By not appointing a town chairman at
this time I feel it is very wrong for the simple reason the town has
to keep moving ahead. And with all of the obligations that are put on
the Town Chair, temporary it is not going to work. It works fine for
one meeting if the Chairman is not there the board can appoint a
Chairman for that meeting. When it gets down to the line should we
go ahead and seek incorporation so that is something that we have to
decide as a town board. Or should this be put on hold while in
negotiations with the city of Elkhorn and Delavan, what is going to
happen to the lake projects, dredging of wet ponds? If, the board
were to wait until November for another election, who is going to
carry out the town chairman’s obligations for the next six months?
The town chairman is head of the planning commission, finance
committee, public works, with all of the road work scheduled this year
is over $200,000. He is also ahead of the emergency government what
if a disaster should happen in the town of Delavan, the town chairman
is head of that. He must be willing to meet with developers, and seek
proper and desirable growth for the town of Delavan while protecting
our natural resources making our town board meeting agendas conduct
town board meetings Roberts rules. The town chairman needs to wear
many hats, performing the job as chairman. I am willing to accept
these obligations provided by law for the town chairman’s position.”

Motion passed 3-2 selecting Wayne Polzin as town chairman
Discussion/possible action for appointment for Committee
Chairpersons: Lake Committee, Park Committee, Fire
Committee, Public Works, Police Committee, Finance Committee,
Administrative Committee
Wayne Polzin stated, “This would have to be done on a temporary basis
as we do not know who the next town board members will be, they have
to be part of the town board and part of the selection for the
committees. Committee should not lay; it will be a full month before
we have a full town board. I would like to put any extra heavy load
on the members now of the town board Temporary Chair for the
Committees.”

Bill Endisch stated, “The ordinance states that a town board person
should share a committee and town board members are co-chair with the
exception on the Lake and the Park. Is it legal to have Treasurer and
Town Clerk as chair of a committee? The attorney should answer that.
Wayne Polzin changed Town Clerk and Treasurer was replaced with Kay
Franzen chairing those committees. These are temporary appointments
until we have a full town board.
Dave county board member asked “Is it appropriate to ask that if
people want be on a committee member or Supervisor, submit letters of
interest with possible interest.”
Wayne Polzin said to, “Send resumes to Town Clerk or Town Chairman,
for appointments on Supervisors or committee members.”
Adjournment
Wayne made a motion to adjourn the meeting; it was 2nd by Jim
Wolfgram
The meeting was unanimously adjourned at 7:45 PM
