MINUTES OF PUBLIC HEARING OF
August 15, 2006

A public hearing for the Town of Delavan was held in the town hall
after due notice had been posted.
The purpose of the public hearing was to take testimony of citizens
regarding the levying of a special assessment upon properties
benefited by the repair and restoration of Sunnyside Court, located
approximately 300 feet west of State Highway 67 and South Bayview
Road.

Chair Pelletier called the meeting to order at 6:45 p.m.

There was a quorum present for doing business.

a.Acceptance of record of publication and notice of mailing into the
hearing minutes.  
	Chair Pelletier stated the record of publication has been provided
and asked Clerk 	Endisch if she sent the notices to the residents of
Sunnyside Court.  Clerk Endisch 	responded yes she had.

b.Objection, criticisms and objection of property owners as to the
necessity of the repairs and restoration.
	Chair Pelletier asked if any of the members of the audience had any
comment, question 	or criticism of the action presented.  

	Donna Johnson – 144 Sunnyside Court asked, in the patching and
resurfacing to be 	done if 	the water drainage issue was going to be
addressed.  She asked if the town 	engineer had addressed the slope of
the street which is part of the problem with 	drainage.  Chair
Pelletier responded the engineering specifications would extend the
life 	for an estimated ten years.  The Town never intended on
reengineering the road.  	Attorney Wassel added the residents of the
road in the past were unwilling to sign up 	to do this, and the town
was looking at keeping the cost for the road repair as modest as
	possible to try to make the best solution for both the town and the
residents.  Ms. 	Johnson asked about the assessment; five year @ 7%
each year.  	Chair Pelletier 	responded the town will not be borrowing
the monies and they would have multiple 	options on how to pay the
assessment.  Ms. Johnson asked when 	the estimated start 	date is. 
Chair Pelletier responded the contractor was prepared to start the
work three 	weeks ago but because of the necessity of having a hearing
and a final resolution passed 	the work couldn’t be done at that time.
 He wasn’t sure when the work would occur; but 	he estimates it would
only take a couple of days to complete.

	Mike Nettesheim – 131 Sunnyside Court asked, assuming this is
approved how will they 	opt to defer for the five years?  Chair
Pelletier stated this would be the same as their 	taxes. 	Clerk
Endisch stated they would be receiving notification of their options
by mail 	within a week or so.  Nettesheim asked what if someone signed
a release and now 	changed their minds.  Chair Pelletier stated the
Town has signed releases from all 	members on the street, which would
hold up in court.  Mr. Nettesheim asked about the 	other roads?  Had
any others opted to repair their roads? Pelletier responded no; but
that 	doesn’t mean the town won’t make an attempt to plow their roads
or answer emergency 	calls.  He said there are five roads in the same
situation as Sunnyside Court; and none 	have opted to repair. 

	Amy Anhold – 137 Sunnyside Court asked if these roads were
impassable to get to their 	road would the town be able to plow, etc. 
Pelletier responded yes they would.

	Mike Johnson – 144 Sunnyside Court asked what needs to be done to
have the town take 	over their road.  Mr. Johnson said they are
taxpayers and feel their road should be treating 	like any others.
Chair Pelletier responded the road would need to be brought up to the
	town’s 	standards.  Pelletier added there are approximately 35-40
miles of private roads 	in the town; their street is not unique.  To
bring most of these roads up to town standards 	would be very
expensive and the rest of the taxpayers should not be responsible for
doing 	this, that would be the owners on the individual streets to
bring up to standard.
