MINUTES OF TOWN BOARD MEETING OF December 18, 2007 The regular monthly meeting of the Town of Delavan Town Board was held at Town Hall after due notice had been posted. Chari Polzin called the meeting to order at 7:00 p.m. Chair Polzin stated that we lost one of our former fireman (John Jarosz Jr.) moments of silence. Clerk Dixie Bernsteen called the roll, all present Pledge of Allegiance Press: Mike Hoey Audience: Approximately _30_ people Communications: Received a letter from Paul Ryan’s office that a new person has been hired to help towns apply for grants. Comments and suggestions of citizens present: Don Holst gave an update on Mound Road Project (on file) Supervisor Jones received a call from developer of the Covered Bridges, questioned our intentions of traffic on South Shore, and reaffirmed to him that it is not acceptable. He stated they will be changing their plan so there will no longer be access on South Shore Drive in their plans. The developer also has emailed the town and asked to be present at a meeting. Chair Polzin stated as of last evening the Police and Fire Commission has made a decision to appoint Phil Smith as the new Chief Police. Supervisor Wolfgram in the audience we have city alderman Dave Kilkenny a member of the Lake committee, discussed how the funds the city disperses to the town for the Lake. Dave stated that as of November their balance sheet currently has $76,166.40 in funds. The YTD collection of room tax is $354,475. A loan was taken out previously to pay the town and the city is still paying the loan off with principle and interest of a balance of $801,000. The City needs about $400,000 to pay the loan first. There is a balance of $76,166.40 available now and additional monies will be available in the future. The city is in need of a letter for request for the money and documentation of expenses. Approval of Minutes: a. Town Board Minutes of November 20, 2007 Supervisor Jones made a motion to dispense with the reading of the minutes and approve the minutes for the Town Board Meeting November 20, 2007, second by Supervisor Franzen. Motion carried unanimously. b. Work Meeting Minutes of December 12, 2007 Supervisor Sessner made a motion to dispense with the reading of the minutes and approve the minutes for the Town Board Meeting December 12, 2007, second by Supervisor Jones. Supervisor Jones had one correction of item G, suggestion of rezone at the end of Valencia Dr, land is already rezoned B-1. Motion carried unanimously with corrections. Town Board Reports: All committee and Town Reports are on file in the Town Hall Office. Treasurer’s Monthly Report: Treasurer Morelli gave the Treasurer’s report all general purpose account is 1,530,323.44; Lake Project pending audit expenditures is $628,540.42. Chair Polzin made a motion to accept the Treasurer’s report as written and place it on file in Town Hall with a second from Supervisor Franzen, the motion carried unanimously. Finance Committee Recommendation Regarding Payment of Monthly Bills: Supervisor Franzen made a motion to pay bills starting with check number 49284 thru check number 49477 with a second from Chair Polzin, the motion carried unanimously. Old Business: NONE New Business: a. Discussion/possible action on recommendation of the Plan Commission to the board to approve several variance set backs for existing building to Sam Cuzo/Rueben, lot 2, 2826 Manor Lane, Tax Key # FD32000074A, Clerk to send letter to County that the board has approved their variances. Supervisor Jones made a motion on recommendation of the Plan Commission for the board to approve the variance set backs for existing building that were asked for on the petition for variance that was submitted to Walworth County Board of Adjustment. (Sam Cozzo/Rubino, lot 2, 2826 Manor Lane, Tax Key # FD32000074A, second by Supervisor Franzen.) Citizen stated with no objections to the motion, he would like to point out that Mr. Cuzo name is spelled Cozzo and Mr. Rueben is Rubino. The set backs for the existing building and a proposed addition: the addition was not affecting the lake or anything else. When the letter comes if it could also state that? Supervisor stated that this was covered, as specified on your application to the County. Motion approved unanimously. Clerk to send letter to County that the board has approved their variances. b. Discussion/possible action on recommendation of the Plan Commission to deny Belvidere Park, 2385 South Shore Dr, Tax Key #’s FB0001A-1A, FD2700025, FHA000020 rezone from present R2A and C2 to R4 due to Tax Key’s are on separate sides of the road; Clerk to inform County to deny rezone. Supervisor Jones made a motion on recommendation of the Plan Commission to the town board that the town board contact the Land Division of Walworth County and recommend denial of the rezone request from R2A and C2 to R4 as it is directly opposed to our current trend and rezones around the lake. It would tend to increase densities as opposed to our philosophy to decrease density, a second by Chair Polzin. Motion carried with a vote of 4-1, Supervisor Wolfgram opposed. c. Discussion/possible action on recommendation of the Plan Commission to the board to approve Roberto and Hilda Reyes, 608 State Hwy 50, Tax Key #’s FIN400001 and FIN300093 to combine into one parcel. Clerk to inform County of recommendation. Discussion/possible action on recommendation of Plan Commission to the board to approve Wisconsin Power and Light Company 4902 N Biltmore Lane Madison, Tax Key # FD9-8A, 6396 Mound Road; a variance to reduce set back on North side to 30ft and reduce set back 12ft along North side lot line and 25 ft along East lot line. Clerk to inform County of recommendation. Supervisor Jones made a motion on recommendation of the Plan Commission to the town board to approve Wisconsin Power and Light Company 4902 N Biltmore Lane Madison, Tax Key # FD9-8A, 6396 Mound Road; a variance to reduce set back on North side to 30ft and reduce set back 12ft along North side lot line and 25 ft along East lot line with a second by Chair Polzin, motion carried unanimously. e. Discussion/possible action on recommendation of Plan Commission to the board to approve John Boughton 2556 North Shore Drive, Tax Key # FS10001111; a variance for existing garage 35 X 40 (1400sqft) ordinances is limited to 1200 sq ft for unattached building. Clerk to send letter to County that the board has approved their variances. Supervisor Jones made a motion on recommendation of the Plan Commission to the town board to approve John Boughton 2556 North Shore Drive, Tax Key # FS10001111; a variance for existing garage 35 X 40 (1400sqft) ordinances is limited to 1200 sq ft for unattached building, second by Chair Polzin motion carried unanimously. f. Discussion/possible action on recommendation of Administrator Olson to the board to approve cell phone reimbursement of ½ of Town Chair’s cell phone bill not to exceed $40 per month. Supervisor Sessner made a motion on recommendation of Administrator Olson to approve cell phone reimbursement of ½ of Town Chair’s cell phone bill not to exceed $40 per month, second by Supervisor Franzen with Chair Polzin abstaining from voting. Motion carried. g. Discussion/possible action on the recommendation of Administrative Committee to the board to lease the new photo copier from Stan’s Office Supply at a cost of $189.00 per month for 5 years including service agreement and a cost per page for black and white at $0.009 and color at $0.032 per page. Discussion/possible action on the recommendation of the Administrative Committee to the Board to approve the amended liquor license for Joey’s Eatery (Waterfront) contingent on letting the town know the date of opening. Chair Polzin made a motion on the recommendation of the Administrative Committee to the Board to approve the amended liquor license for Joey’s Eatery (Waterfront) contingent on letting the town know the date of opening with a second by Supervisor Franzen. Supervisor Jones had concerns about building being demolished and operating both businesses. Motion carried unanimously. i. Discussion/possible action on the recommendation of the Finance Committee to the board to approve proposal for the final 2007 audit. Supervisor Sessner made a motion on the recommendation of the Finance Committee to the board to approve proposal for the final 2007 audit of $15,000 plus provisional of additional fees in connection with closing the town books and reconciling account balances with an additional fee of $2400, second by Supervisor Wolfgram, motion carried unanimously. j. Discussion/possible action on the recommendation of the Lake Committee to the board to set further action for Brown’s Channel to resolve resolution assessment. Supervisor Wolfgram made a motion to table until next month second by Supervisor Sessner, motion carried unanimously. k. Discussion/possible action on recommendation of the Police and Water Safety to the board approve ordinance to reduce speed on Countryside Dr., Blue Gill Rd, Blue Heron Dr, County View Dr, Fox Lane, Foxtail Lane, Linn Rd, Prairie Dr, Sage Rd, South Shore Drive from intersection of State Hwy 50 southwesterly to intersection of Bailey Rd, South Shore Drive from Robbins Street westerly to Carol Street. Chair Polzin made a motion on recommendation of the Police and Water Safety to reduce the speed on Countryside Drive in conjunction with other roads that are already at 25 MPH. Chair Polzin made a motion to dispense with the reading of the ordinance and go on to the second reading with a second by Supervisor Jones, motion carried unanimously. Chair Polzin made a motion to dispense with the second reading of the ordinance and approve it with a second by Supervisor Sessner, motion carried unanimously. l. Discussion/possible action on recommendation of the Highway Department to the Board to use $9000 from 2007 Hwy fund that has $60,000 left in it. Chair Polzin made a motion to table this until next month, with a second by Supervisor Franzen; Supervisor Wolfgram opposed, motion carried. m. Discussion/possible action on recommendation of the Chair Polzin to the board that we decide on what to give the employees as a Christmas gift. Suggestions gift card (gas, restaurant, Wal-Mart, Lowes, Visa, MasterCard, American Express or establishment within the town) $25.00 check with taxes taken out, any other suggestions are welcome. A decision needs to be made who is eligible. Chair Polzin made a motion to give all full time employees (Highway, Police, Mechanic, Town Office, Fire Chief, Rescue Chief, Jamie Jarosz, Mickie Mraz, and Sandy Walter) the $25.00 gift card from Walworth State Bank with a second by Supervisor Jones, motion carried unanimously. n. Discussion/possible action on recommendation of Attorney Wassel to set a date to have a closed session regarding Hansen and Mayer disputes. Chair Polzin made a recommendation to have the meeting on Thursday, December 20, 2007 at 3PM with a second by Supervisor Wolfgram, motion carried unanimously. 11. Adjournment Supervisor Jones made a motion to adjourn with a second by Supervisor Franzen, motion carried unanimously.
