MINUTES OF PUBLIC HEARING OF 
December 20, 2005

A public hearing of the Town of Delavan was held on Tuesday, December
20, 2005 at 6:30 PM in the main meeting room at Town Hall, 5621 Town
Hall Rd., Delavan WI  53115.

Chair Herman called the meeting to order at 6:30 p.m.

There was a quorum present for doing business.

1.Opening of Public Hearing:  Chair Pelletier opened the public
hearing to order at 6:30 PM on December 20, 2005 pursuant to Section
60.785 (b) Wisconsin Statutes for the purpose of adding territory into
the Delavan Lake Sanitary District.

2.Acceptance of record of publication and notice of mailing into the
hearing minutes:
Chair Herman  Pelletier stated that Kevin MacKinnon representing
DLSD, Dave Petzelt – Shodeen Construction, Ed Brien – President DLSD,
were present as per notification of hearing.  Chair Pelletier asked
the clerk to add to the record the record of publication and notice of
mailing into the hearing minutes.  Clerk Endisch responded the notice
was published in the Delavan Enterprise on two consecutive weeks,
December 8, 2005 and December 15, 2005.  Clerk Endisch also sent
notice to the DNR and the Department of Commerce.  

3.Acknowledgement of written comments filed:  Chair Pelletier asked
the clerk if there were any written comments filed and the clerk
responded no.

4.Objections, criticisms and objections of property owners as to the
necessity of the addition and the question of whether property will be
benefited by addition to the district:

No comments.

Supervisor Malsch asked Kevin MacKinnon for a brief summary of
territory.  

Mr. MacKinnon introduced himself and stated he was appearing on
behalf of the Commissioners of the DLSD to speak in support of adding
this territory to DLSD.   Mr. MacKinnon stated that over the past two
years, the property owner (Shodeen) has acquired lands that are
located within and adjacent to the boundaries of DLSD.  The property
owner has provided a preliminary land use plan to the Town for
developing these lands.  In November, the Sanitary District Commission
received a request from the land owner to have all of their property
to be included within the Sanitary District boundaries.  After review
of this request, the Commissioner’s passed a resolution requesting the
Town to hold a public hearing and consider adding these lands to the
District boundaries.  MacKinnon outlined on a map the area petitioned
to be added.  MacKinnon added that since the property owner has
indicated a desire to develop these lands for public use and because
these lands are located within the Delavan Lake watershed, the
District Commission support the addition of the lands to the Sanitary
District. 

MacKinnon added this would be an extension of the Savannah Woods
proposal, which could be supported by the current DLSD facilities. 
Supervisor Hummel asked about the Cobian property, what will happen to
them.  Dave Patzelt stated it was his understanding the individuals
could remain as they are today, but could connect or asked to be
annexed into the district at any time.  Chair Pelletier stated that
legal counsel at the last annexation warned the board of creating
islands within the DLSD, counsel frowned upon this.  Dave Patzelt
responded the counsel for the DLSD didn’t think it was improper; DLSD
doesn’t want to force any property owners to connect if they don’t
want to.  Supervisor Polzin stated this wasn’t an island, as it does
have public access.  Chair Pelletier asked if this was going to have
any impact on the rest of the residents within the DLSD.  Kevin
MacKinnon stated no, this is a stand alone project with no impact.    

5.Comments and advice by the Department of Commerce and the
Department of Natural Resources:
Chair Pelletier asked if the clerk had received any correspondence
from either agency and the clerk responded, no.

6.Closing of Public Hearing:  Chair Pelletier made a motion to close
the Public Hearing with a second from Supervisor Nowak and the motion
carried unanimously.

 Chair Pelletier closed the Public Hearing at 6:45 PM.
