February 19, 2008 Town Board Meeting

MINUTES OF TOWN BOARD MEETING OF
	February 19, 2008

The regular monthly meeting of the Town of Delavan Town Board was
held at Town Hall after due notice had been posted.

Chair Polzin called the meeting to order at 6:00 p.m.
Chair Polzin stated to let the record show that all board members
were present.
Pledge of Allegiance
Chairman Polzin stated there was a quorum for doing business.

Communications:
a.	Letter from Neighbors of the Delavan Highlands, concerned about
cars parked on the black top South Shore Drive.  Police have been
ticketing those vehicles.  A new ordinance will be created to solve
the problem.
Comments and suggestions of citizens present:
a.	Mitch Olkowski 4112 Beach Street, Carol Street to Central is a
natural water way for the lake, and this is being tore up from all or
the cars parking their.  Who is going to pay for all of the damage
that is occurring?
Approval of Minutes:
	Supervisor Jones made a motion to dispense with the reading and
approve minutes of Town Board Meeting January 15, 2008, Special Town
Board Meeting January 22, 2008, and Town Board Work Meeting February
13, 2008 with a second by Supervisor Wolfgram minutes approved
unanimously.  Minutes from Special Plan Commission Meeting; January
22, 2008- No action was taken, to be approved at Plan Commission
Meeting.
Town Board Reports:  All committee and Town reports are on file in
the Town Hall Office.
a.    Treasurer’s Monthly Report
	The reports as of December have not been able to do due to taxes and
auditor.  At the end of Novermber the total in all general purpose
accounts $1,664,462.19; the Lake Fund pending auditor adjustments is
$630,831.72.
	Supervisor Sessner made a motion to receive the Treasurers Report
and place it on file, with a second by Supervisor Franzen, motion
carried unanimously.
b.   Finance Committee recommendation regarding payment of monthly
bills check numbers 49718          to 49778, 051064 to051116, 051143
to 051166, 051207 to 051236, 051284 to 051349.
	Supervisor Sessner made a motion to approve checks numbers 49718 to
49778, 051064 to 051116, 051143 to 051166, 051207 to 051236, 051284 to
051349, with a second by Supervisor Jones.
	Supervisor Wolfgram commented on page two, the last two checks Bert
Truck Equipment and Peterbuilt, how it was procured was gone about the
wrong way, he did not remember seeing any specs for it, it was never
bid out, and is over $8,000 over budget.  He did not agree with it at
all.
Chair Polzin stated that is was bid out through the public works, we
had two bids that we had got in and as far as the truck goes it was
not that much over.  The public works we had made the recommendation
for the budget of $126,000 and John changed it to $129,000 so the
truck came in at $129,000.  What we put in was $3,000 off and if you
can come in with any piece of equipment of that size any closer to a
bid I would be happy.  But, you are not going to get it any closer
than that, not only that on a piece of equipment by law you are not
required to bid it.
Supervisor Sessner pointed out that we were down one truck and needed
a lot of work.
Supervisor Jones wanted clarification on check numbers, on the second
page there is a note written void all above, was am wondering what
that is about.  Treasurer Morelli cleared the concern stating it is
the new system and the checks did not run correctly so the Deputy
Clerk had to be void them.  Motion carried 4 to 1, with Supervisor
Wolfgram voting against.
c.    Committee Reports on File	
Old Business:  None
New Business:
a.	Discussion/possible action on recommendation of the Plan
Commission to hire an attorney that specializes in development law.
No action taken.  Plan Commission is to look into finding a candidate
for the position
b.	Discussion/possible action on recommendation of the Administrator
John Olson to give a donation to the East Delavan Union Cemetery
Association.
Chairman Polzin made a motion to approve the $3,700 with a second by
Supervisor Jones,    motion carried unanimously.
c.	Discussion/possible action on recommendation of the Administrator
John Olson to adopt the developers’ agreement for Windward Hills
Condominium Project.
Supervisor Jones made a motion to approve the Windward Hills
Condominium Project with a second by Supervisor Wolfgram, motion
carried unanimously.
d.	Discussion/possible action of the Town Board to make a decision on
what to do with the monies received from the insurance company for the
damaged police vehicle; fix the damaged car or do something else with
the money.
Chairman Polzin made a motion to not fix the damaged vehicle and use
it for parts for other police vehicles, with a second by Supervisor
Wolfgram, motion carried unanimously.
e.	Discussion/possible action on recommendation of the Park and
Tourism Committee to adopt Resolution 2-2008; authorizing application
for financial assistance with the Wisconsin Water Ways Commission.
Supervisor Franzen made a motion to approve Resolution 2-2008, with a
second by Supervisor Jones, motion carried unanimously.
f.	Discussion/possible action on recommendation of the Public Works
Committee to approve the purchase of the mezzanine for the mechanics
storage.
Chairman Polzin made a motion to check with Building Inspector to be
sure we are compliant.  The authorization is given to the Mechanic to
purchase the mezzanine.  Motion carried unanimously.
Adjournment
Supervisor Jones made a motion to adjourn with a second by Supervisor
Franzen, motion carried unanimously.

Chair Polzin adjourned the meeting at 6:55 PM.
