MINUTES OF TOWN BOARD MEETING OF July 17, 2007 The regular monthly meeting of the Town of Delavan Town Board was held at Town Hall after due notice had been posted. Chair Polzin called the meeting to order at 7:00 p.m. Clerk Bernsteen called the roll. PRESENT; ALSO PRESENT; ABSENT/EXCUSED Chair, Wayne Polzin Treasurer, Patricia Morelli PW Foreman, Mike Petkoff Supervisor, Kay Franzen Clerk, Dixie Bernsteen Supervisor, Supervisor Wolfgram Police Chief, Andrew Mayer Supervisor, Frank Jones Fire Chief, Gerald Edwards Supervisor, Herb Sessner Mechanic, Tom Thiele Town Attorney, Steve Wassel Press: Mike Hoey Audience: Approximately __20__ people Chair Polzin declared a quorum present for doing business. Communications: Clerk Bernsteen, thanked the board for letting her go to the UW-Green Bay Clerks Schooling. Complaint letter received from Carol Coccia to be put on record that it was received by the Town Clerk. Clerk Bernsteen read statement about disappointment in board for Work Meeting held while she was gone. Copy of Statement of file with Clerk Comments and suggestions of citizens present: Marvin Herman stated he felt we do not need an Administrator. Chief Mayer item 8 on agenda, concerns about Chair having key to Police Department. Rocky Feeney: “Thanks, I couldn’t think of anything he would rather be doing than be here.” Don- Deischsel concerns when calling police department in early morning hours was not able to get through, finally after several messages, then got legal message or call 911. Chief Mayer, stated there are 2 numbers for the police department that are published in phone book, the 728-9777 goes directly to the Sheriff’s Department when no officers are available. The 728-8787 is an administrative number; those calls are answered in the morning. Approval of Minutes: Chair Polzin made a motion to dispense with reading and approve minutes for June 19, May15, April 17, June 5 and June 6. Motion was second by Supervisor Jones. June 19 minutes Minutes approved unanimously. May 15 Minutes approved unanimously with corrections. April 17 Herb Sessner abstained from voting, due to he was not here. Minutes approved unanimously with corrections. June 5 Minutes approved unanimously. June 6 Supervisor Wolfgram abstained from voting, due to he was not here. Minutes approved unanimously with corrections Town Board Reports: All committee and Town Reports are on file in the Town Hall Office. Smart Growth letter read by Supervisor Jones and is on file with clerk. Treasurer’s Monthly Report: None Chair Polzin stated that it should be her priority to work on. Finance Committee Recommendation Regarding Payment of Monthly Bills: Supervisor Sessner made a motion to pay bills starting with check number 48762 thru check number 48877 with a second from Supervisor Jones and the motion carried unanimously. Committee Reports: Old Business: Supervisor Wolfgram: Inlet project information together from engineer for preliminary cost for the remainder of this year and next year. Possibly at the end of moth a special meeting to discuss Inlet project at that time. New Business: Chair Polzin made a motion to deviate from agenda and go to item 11 (Cameron Project) second by Supervisor Jones. Motion carried unanimously. Approval Operator licenses Leticia Perez, Mary Markling, Bridget McMahon, Corey Schroeder, John Schroeder, Tom Becker, Kory Lebow, David. Becker, Marcus Nolan, Sue Phelps. Two others are conditional upon completion of schooling, Kimberly Minton, Brooks Christy. Motion to approve operator’s license, excluding Kimberly Minton and Brooks Christy. Supervisor Franzen made a motion to approve the operator’s license for Leticia Perez, Mary Markling, Bridget McMahon, Corey Schroeder, John Schroeder, Tom Becker, Kory Lebow, David. Becker, Marcus Nolan, Sue Phelps second by Chair Polzin. Motion carried unanimously. Supervisor Franzen made a motion to approve conditional license until schooling has been completed for Kimberly Minton and Brooks Christy. Second by Chair Polzin motion carried unanimously. Approval of a new postage machine Supervisor Franzen made a motion to lease mail machine through Pitney Bowes for $101.00 per month, second by Supervisor Wolfgram. Motion carried unanimously. Approval to repair Hiawatha and Beckman Drives charges put on their Taxes Chair Polzin made a motion to approve minor repairs on Hiawatha and Beckman Drives with triangle lime chips and to be charged back to the property owners pursuant to our ordinance. Mr. Feeney requested that before it gets put down as a base he would like all the old rubble underneath it to be cleaned off, so it does have a good base on it, if you are going to come back and put black top on it. Second by Supervisor Jones motion approved unanimously. Notice to owners of property on Hiawatha Drive and Beckman Drive that the town will resurface their roads in 2008 owners will be assessed full cost for all work Chair Polzin made a motion to send notice of intent to the property owners on Hiawatha and Beckman Drives that the Town will resurface their roads in 2008, be put on with a special assessment at the full cost of all of the work. Second by Supervisor Sessner, motion carried unanimously. Approval of road work bids in the Town of Delavan for 2007. List of roads on file Accepted bids from B. R. Amon and Sons and Scott Construction Seal coat bid from Scott Construction was $67,657.80 Overlay bid from B. R. Amon was $71,458.00 Supervisor Sessner made a motion to accept the bid for Seal Coat from Scott Construction for $67,657.80, second by Chair Polzin, motion carried unanimously. (Seal coat, North Shore, Cedar Point, North Shore West., Summit Drives and Sun Meadow Court). Supervisor Sessner made a motion to accept the bid for Overlay from B.R. Amon and Sons, for Hillcrest Dr, Green Meadow Dr, Mound Road, County F to the bridge, second by Chair Polzin, motion carried unanimously. Discussion and possible action to repeal and recreate Resolution No. 178 regarding reimbursement of expenses Chair Polzin made a motion to dispense of reading of first Resolution 178 and go onto the second reading to repeal and recreate Resolution #178, second by Supervisor Franzen. Motion carried unanimously. Chair Polzin made a motion to dispense of reading of second Resolution #178 and to approve to repeal and recreate Resolution #178, second by Supervisor Sessner. Motion carried unanimously. Discussion and possible action for Town Chairman to retain town charge card until new charge cards are made out with proper wording on them. The charge cards should be made out toThe Town of Delavan Government, Office, Name of person receiving card Chair Polzin made a motion to get different charge card for the Town of Delavan without a fee, and be made out in The Town of Delavan with the Clerks and Town Chairman’s names on the cards. Motion second by Supervisor Jones, motion carried unanimously. Discussion and possible action to supply Town Chairman with keys to all town buildings along with keys for all offices in the town hall excluding the file room and the Judge’s office Police Department has a key to every town building; each squad car has a set for each building. Clerk is concerned about having daily used files open. The file cabinets that are in her office with the daily files do not have locks on them. Clerk requests to purchase new file cabinets, before turning over key to Chairman. Chair Polzin made a motion to have keys to Annex Building, Clerks Office second by Supervisor Sessner. Motion carried unanimously. Discussion and possible action for Frank Jones and Wayne Polzin to attend Towns Association meeting in DePere WI. On July 25th 2007, with full reimbursement for all expenses for Town Board Members attending Chair Polzin made a motion for Supervisor Jones and Chair Polzin to be reimburses for all expenses for the meeting to be attended by them on July 25th. Second by Supervisor Wolfgram, motion carried unanimously. Discussion and possible action regarding protocols for posting of committee agendas Attorney Wassel suggests a motion be made so long as they furnish their agenda to the clerk that she be the person for the posting of the agenda, make the clerk be responsible for distribution of the agendas. Supervisor Sessner, so made with a second from Supervisor Jones, motion carried unanimously. Recommendation approval of the June 13, 2007 Cameron Estate Condominium plat Chair Polzin made a motion for the recommendation the approval of the June 13, 2007 Cameron Estates Condominium Plat. Second by Supervisor Jones. Discussion, Supervisor Jones procedures of planning commission that changes required and the board does not know what had been submitted to the County. Need copy of final product before it goes to the County. John Claire attorney from the City of Delavan stated it was unanimously recommended to be approved by the planning commission subject to certain revision. The revision was a removal of a common element from unit one down to the lake, that was removed. Motion carried unanimously. Chair Polzin made a motion to go back to regular agenda with a second form Supervisor Wolfgram, motion carried unanimously. Closed Session Chair Polzin made a motion to go into closed session under state statue 19.85 (1) (g) to confer with legal counsel for the governmental body who is rendering advise concerning strategy to be adopted by the Town with respect to litigation that the Town is or likely to be involved in, regarding potential claim against Hey and Associates. Second by Supervisor Jones, motion carried unanimously. Chair Polzin made a motion to authorize attorney to file suite against Hey & Associates for recovery a second by Supervisor Jones. Roll call vote Chair Polzin Aye, Supervisor Franzen Aye, Supervisor Wolfgram Aye, Supervisor Jones Aye, Supervisor Sessner Aye, motion carried unanimously. Supervisor Jones made a motion to go out of closed session, Supervisor Franzen second. Motion carried unanimously. Motion for adjournment Supervisor Jones made a motion to adjourn with a second by Supervisor Wolfgram. Motion carried unanimously.
