Minutes of 2010 Budget Hearing, Town 
Electors Meeting and Special Town Board Meeting 
November 10, 2009

Budget Hearing
Chair Burwell called the hearing to order at 7pm
Chair Burwell thanked everyone for coming, appreciates everyone’s
input, and is an extremely tough budget year.  The board has had to
cut a lot of things that normally would not have been cut, donations
to organizations that the board believes in, a full time highway
person and part time Deputy Clerk.  Chair Burwell also thanked the
clerk, treasurer, dept heads, committee members, Finance Committee
especially Supervisor Militello and Administrator Olson for the hard
work they did on the budget.  
Administrator Olson presented budget summary (on file).  
Comments and Suggestions from Citizens
Patti Marsicano 221 Inlet shore Drive, respects all the work that the
board does and worked hard at the budget.  Last year the Town and City
of Delavan included $7,000 in there budgets, the Historical society
has used this money along with money raised to secure a location, and
preserving Delavan’s History; something that has not been done in the
past.  In the past year they have had a booth at the Walworth County
Fair Genealogy Society Family History Fair and Town of Delavan Native
American Days.  The committee has also put together a booklet about
the Indian Mounds in Delavan; which is on sale.  Hosted an exhibit of
E-towns and Mix, with many contributions from home owners and
businesses, Ron Marco donated the Tour money he collected to the
Historical Society, a book signing for Ellen Bell author of the book
Lake Lawn, along with book sales, held a double feature matinee at the
Old Theatre with pop corn sales. The Historical Society had applied
for and a grant through the State Historical Society and were denied,
due to Delavan being affluent enough to support it.  The Committee
also hosted several free work shops and have several things planned
for the coming year.  On behalf of the Historical Society she requests
that the Town budget more than the $1,000 to the Historical Society. 
The Historical Society welcomes everyone to the Grand Opening of the
Delavan Historical Society on November 19 from 3PM to 8PM.  Chair
Burwell stated that she does agree with the Historical Society; but
due to the economy our room tax is lower than normal, if the economy
does change the Town will keep them in mind for more donations. 
Don Diechsel 4021 Cardinal Lane asked for an explanation on the debt
service, you have $398, 875 for 2010 and in the explanation you have
$1.2M in debt coming up, is that part of the $398 and $448; is there
money put back for that, or where is that $1.2 M coming from. 
Administrator Olson stated after the $398 is paid in 2010 we will have
approximately 1.2M of long term debt left.  Don Diechsel stated that
we have already encompassed that debt but we have paid off $398 of
that debt, Administrator Olson stated yes.
Marvin Herman asked if it is in order to propose some type of motion
to increase the budget for the historical society or are we just out
of luck.
Attorney Sholze stated this is a public hearing for comment on the
budget, when we get to the meeting of electors; this is your
opportunity to urge the board to take that action, but unfortunately
or fortunately depending on how you look at it the statutes put the
burden of creating the budget and how the funds are to be expended on
the board; the electors have the responsibility to set the tax levy. 
The electors do not have the authority to say to the board we want you
to specifically to spend it on this, but during this hearing you have
opportunity to express your wishes and concerns and can take that into
consideration on the final budget.

Town Electors Meeting
Chair Burwell opened the meeting of the Electros at 7:20PM.  Chair
Burwell stated that pursuant to Section 60.12 (1) (a) of Wisconsin
Statutes by the Town Board for the following purposes will be held:

a)	To adopt the 2009 Town Tax Levy to be paid in 2010 pursuant to
Section 60.10 (1) (a) of Wisconsin Statutes

Chair Burwell asked if anyone had any comments or questions.  
Marvin Herman asked if this was the point where an elector can make a
motion in regard to the Historical Society.  Attorney Scholze stated
an elector can make a motion at this point but the possible motions
available are extremely limited: because this is a special meeting of
electors the jurisdiction or authority is limited to the notice on the
meeting agenda, which is to adopt the Town Tax 2009 Levy paid in 2010.
 So it is appropriate for an elector to adopt the tax levy.  Marvin
Herman made motion adopt the 2009 Town Tax Levy to be paid in 2010
pursuant to Section 30.10 (1) (a) of Wisconsin Statutes with a second
by John Pelletier, motion carried.  Meeting Closed at 7:23PM

Special Town Board Meeting

Chair Burwell called to the meeting to order at 7:23PM
Pledge of Allegiance
Clerk Bernsteen called roll, present were Chair Burwell, Supervisor
Simons, Supervisor Sessner, Supervisor Militello, and Supervisor Jones
excused.
Chair Burwell sated there was a quorum for doing business
Communications None
Comments and Suggestions of Citizens Present None
1)	Approval of Minutes:
a)	Minutes of the Public Hearing Proposed 2009 Budget--November 11,
2008
Supervisor Militello made a motion to approve the minutes of Public
Hearing Proposed 2009 Budget of November 11, 2008 with a second by
Supervisor Simons motion carried 4-0.  
b)	Minutes of the Special Town Meeting of the Electors--November 11,
2008
Supervisor Militello made a motion to approve the minutes of Special
Town Meeting of Electors, November 11, 2008 with a second by
Supervisor Simons motion carried 4-0.
2)	OLD BUSINESS:  None
3)	NEW BUSINESS
a)	Discussion/possible action on any changes being made in the 2010
Proposed Budget
Chair Burwell stated if there were any changes being made in the 2010
Proposed Budget.  Supervisor Sessner commented on the contributions of
the Historical Society of $1,000, last year we had made a donation to
the Chamber of Commerce and felt that the $1,000 should be split
between the Historical Society and the Chamber of Commerce. 
Supervisor Sessner made a motion to split the 1,000 between the
Historical Society and Chamber of Commerce with a second by Chair
Burwell motion failed 2-2.  Chair Burwell asked if there were any
other changes to the 2010 budget, hearing none.  Supervisor Simons
made a motion to adopt the Proposed 2010 Budget with a second by
Supervisor Militello, motion carried 4-0.
b)	Discussion/possible action on adoption of the 2010 Proposed Budget
Chair Burwell asked if there was any discussion or action on the
adoption of the proposed budget.  Supervisor Militello made a motion
to adopt the 2010 Proposed Budget with a second by Supervisor Simons,
motion carried 4-0
4)	ADJOURNMENT
Supervisor Simons made a motion to adjourn with a second by Supervisor
Militello motion carried 4-0, meeting adjourned at 7:27PM.
