Minutes of Town Board Work Meeting of March 15, 2006

The regular monthly Town Board Work meeting was held in the Town Hall
after due notice had been posted.

Chair John Pelletier called the meeting to order at 7:00 p.m.

Audience: 10 persons 
Chair Pelletier declared that a quorum was present for doing
business.

Communications:
Supervisor Polzin stated he received notification from a resident
regarding the noise level every weekend with snowmobiles on the inlet.
 The notification referred to faulty mufflers, etc.  It was determined
the committee would send the complainant notification regarding the
issue relating the town understs understands their concern but that no
action would be taken at this time..

Chair Pelletier stated he and the board members received
correspondence regarding a 7 pm meeting on 3/16 at a resident’s home
regarding the issues with Valencia Dr.  Pelletier will attend, but
doesn’t think that other board members should attend because of the
quorum issue.  He will report back to the board.

Comments and Suggestions of citizens present:
Susan Vogus – 808 Inlet Shore –Ms. Vogus expressed her pleasure with
the public forum regarding Shodeen Development.  Vogus asked if the
economic impact statement that Dave Patzelt referred to was available.
 Chair Pelletier responded he didn’t think the study was completed. 
Ms. Vogus asked if an Environment Impact Study was to be done and
Pelletier responded he wasn’t sure what she meant by that.  Ms. Vogus
responded items like water related issues, flood plain, trees, etc. 
Pelletier responded that he has met with the county, DNR and SWRPC
last week and with all of these parties having an interest, the
environmental issues would be highly scrutinized.  Pelletier went on
to explain that Marlin Environmental is working on documenting all of
this type of data for Shodeen.  Pelletier stated that evaluations of
water quality, water drainage etc., are being done now and the
agencies are telling Shodeen how the environmental areas need to be
configured.  Pelletier added the state has a formula on how fast water
must leave areas.  The plan that Shodeen was proposing about recycling
for the golf course has been turned down.

Gary DeVries – Mr. DeVries stated there is a problem at the park with
the PA system.  DeVries reported that when talking thru the mikes you
get a harmonic effect.  He would like permission to move the speakers
down from their present location, go over the top of the doors and
change the wiring.  DeVries stated he spoke with Mike Petkoff and Mike
assured him they would be able to help him using the P W bucket truck.
 DeVries stated the wire would cost approximately $ 100.  Chair
Pelletier asked if anything else needed to be updated (speakers, etc.)
and DeVries stated not at this time.  Mechanic, Tom Thiele stated he
would be able to purchase the wire from his wire supplier at a lot
lower cost and will let Gary know what he can do.  It was determined
the item will be placed on the agenda to approve up to $ 250 for
speaker repair.  
        
Old Business:

New Business:
1.Administrative Committee
Supervisor Hummel stated he had quite a few agenda items from
recommendations from the Administrative Committee:
Tobacco License Fee – Increase from $ 5 to $ 50
Assessment Notices – Increase from $ 15 to $ 20 Regular and $ 40 if
request is lesser than twenty-four hour notice
Changing effective dates for Business Licenses from January 1 to
September 1, starting September 1, 2006
Add a wine permit to renters of the Community Center $ 10 fee
Require the renter of the Community Center to bear the cost of hiring
a police officer for all parties in excess of 200 parties and serving
beer and wine @ a cost of $ 30 per hour.
Increase the One-Day Bartender Operators License from $ 1 to $ 5
Refuse Haulers Ordinance – take out of the ordinance; this has never
been enforced
Solicitation permit – increase the fee from $ 25 to $ 50 – rationale
to discourage

Hummel reported the other areas discussed and determined to leave the
same were:
Class “A”/”Class A”, Class “B”/”Class B” and Class “C” liquor
licenses
 Picnic Licenses
Direct Sellers Permits.

2.Economic Growth & Development
Supervisor Nowak stated they are continuing to plow through the
calendar.  

3.Emergency Government
No Meeting

4.Finance Committee
Attorney Wassel stated he would like to add to the agenda the two
taxpayers that were overcharged
 $ 750 and $ 7,000.  Attorney Wassel stated that the property
lister’s office incorrectly entered the number in the roll on both,
one was from open book.  Wassel feels that the error is a combination
of the property lister’s office, the assessor and the Town Clerk.  The
Town Clerk, Endisch responded that her office did verify the
information in the roll, and the amount the assessors office placed on
the data entry form is what was entered, which was incorrect.  Wassel
reported the taxpayers hadn’t reported the error in a timely manner
and Clerk Endisch responded the parties had been talking with the
Treasurer since December.  Endisch added Shari had informed the board
of this issue many times before.  Wassel stated the ultimate issue
here is that the monies need to be refunded to the taxpayer.  Wassel
added that in talking with Shari he wasn’t sure if a chargeback could
be done.    The parties involved are Krueger and Rohrer which both
should be on the agenda as erroneous property charges.

5.Fire & Rescue Committee
Supervisor Polzin reported that about half of the burning ordinance
is completed and the entire ordinance will be done in the next two
months.

6.Lake Committee
Chair Pelletier stated the additional information for the County and
DNR permits for the dredging project have been provided, Liesch is
waiting to hear if complete.

7.Park & Tourism Committee
Supervisor Hummel stated the Community Center Rental Rates should be
on the agenda.

Supervisor Hummel stated the park committee is recommending that $
4,700 be taken from fees in lieu for a new sign along with $ 80 for a
permit from County.  Hummel has checked with DOT and he was told no
permit is needed from them.  This should be an agenda item.
 
Supervisor Hummel stated a not for profit group approached him
regarding holding a fishing derby at community center building. 
Lennon Bus Co. is running the derby and coming up with the $ 500
deposit presents a hardship to them.  Hummel added no wine or beer
would be served and are asking only the deposit fee be waived.  Hummel
added they had the derby last year and didn’t pay anything for the
building.  Hummel stated that everyone else pays, i.e., the Elk Club
had their Luau and they paid for the facility.  Chair Pelletier asked
Attorney Wassel to come up with a simple form for whoever the renter
is, making them responsible for damages.  Both items should be on the
agenda. 

Gary DeVries reported that  people interested in fishing seminar for
the children that he has held in the past and would like to try to do
again this year.  He would like to host around 14 children on the
first day, use the community building for instruction and then take
them out fishing.  DeVries stated he checked with Steve Shoff and June
3rd is available.  He would like to have a brochure printed up, not
sure where was printed on outside or if Cory did.  He just wanted to
know if the Town had any objection to this.  DeVries added the motto
he is using “Get Hooked on fishing not Drugs”.  Chair Pelletier asked
if he advertises this at the schools and DeVries responded yes. 
DeVries was directed to bring the brochure to Town Hall and they would
see if could be done in-house or would need to be sent out.

8.Plan Commission
Chair Pelletier explained about the 5 acre parcel split for Craig
Curry, which was dependent on getting the fellow landowners to agree
on the maintenance of their road, which they wouldn’t agree to. 
Pelletier would like item placed on the agenda to deny the CSM.  Chair
Pelletier asked Attorney Wassel if we could legally do this and
Attorney Wassel agreed it was OK.  Tax Key FD-36-110 2863A/2863B
Ingersoll Place.

Chair Pelletier stated the following are items he would like placed
on the agenda:
Rezone – Somerset Marine from A-1 to A-4 plus construction of storage
building.  5167 State Highway 50, Tax Key FA109800002.
CSM for Chateau Condominium Plat on the old Mitchell property- South
Shore Drive FD2700003 and FD2700001B.
CSM for Garrity Property wants to split off a lot – FD2700035, North
Shore Drive east of Borg Rd.
Extend the moratorium with a new ordinance for an additional six
months.

9.Police Committee
Supervisor Polzin stated they took a tour of the police facility and
that Chief Mayer explained to the committee how he intends to spend
the $ 10,000 furniture allowance.  Polzin added the Chief has found a
good buy a significant amount of the furniture from a vendor who
purchased new furniture and the wrong color was delivered that
wouldn’t fit in and is being sold at a reduced rate.

Supervisor Polzin stated that Chief Mayer would like the swearing in
of the five new part-time officers at the board meeting.  Clerk
Endisch will get names from the chief for the agenda.  
 
10.Public Works Committee
Chair Pelletier stated he received a letter from DLSD regarding the
dam easement, which is asking to move the easement.  Attorney Wassel
will take action on the matter.

Chair Pelletier brought the board up to speed on the Joe Schultz Bay
View Rd. issue.  Pelletier explained the issues and asked Supervisor
Polzin if he could go and speak to the residents on the island about
them taking over the road and agreeing to maintain and report the
finding back to the board.

Pelletier asked how much you can charge for a special highway tax to
rebuild a road.  It was determined the amount could not exceed three
dollars per thousand of assessed valuation per year.  Chair Pelletier
asked about rebuilding a road without getting the homeowner approval
and Attorney Wassel stated you don’t need to but it might not hold up
in a court.  Wassel added the safest route is that everyone signs off
agreeing to the construction or repair.   

Chair Pelletier stated the Driveway Ordinance should be on the
agenda.

Chair Pelletier stated the Public Works Dept. is putting out a bid
notice for a chipper replacement.

Chair Pelletier reported the Public Works Committee approved
advertising for a replacement Public Works Employee.  Pelletier added
the public works member are going to work with the union on the
suggestion of changing the probationary period for a new hire to
twelve months and hope this could be in place before the new hire
comes on board

Chair Pelletier stated the Spring Brush Pick-up notice will be placed
in the newspaper four times as well as posted.  .

Attorney Wassel asked where the de-unionizing the highway foreman. 
Chair Pelletier stated the town board called this off, Mike Petkoff is
doing the job today and there are no issues.  Supervisor Nowak
responded until Shodeen comes on board the town board felt there was
no need.  

11.ETZ Committees
No Meeting

12.Other

Chair Pelletier asked Attorney Wassel where we are with the Hey &
Associates issue.  Attorney Wassel responded until we know where we
are financially on this project he doesn’t want to act.  

Supervisor Polzin stated the Police Chief received a letter from a
nine year old girl complimenting the Police Chief’s effort on serving
the Town of Delavan residents.  

Supervisor Polzin reported the Police Department did a great job
solving the fifteen burglaries.  All suspects were from fourteen to
seventeen years old.

Adjournment:
Supervisor Hummel made a motion to adjourn with a second from
Supervisor Polzin and the motion carried unanimously.  

Chair Pelletier adjourned the meeting at 8:38 PM
