Minutes of Town Board Work Meeting of May 9, 2007 The regular monthly Town Board Work meeting was held at the Town Hall Chair Wayne Polzin called the meeting to order at 6:50 p.m. PRESENT: ALSO PRESENT: Town Chair, Wayne Polzin Clerk, Dixie Bernsteen Supervisor, Kay Franzen Treasurer, Pat Morelli Supervisor, Jim Wolfgram Fire Chief, Gerald Edwards Supervisor, Frank Jones Police Chief, Andrew Mayer Supervisor, Her Sessner Absent Highway Foreman, Mike Petkoff Absent Mechanic, Tom Thiele Audience: Approximately 20 people Chair Polzin declared that a quorum was present for doing business. Chairman Polzin commented that Herb Sessner will be here shortly after 7 PM Communications: None Comments and Suggestions of citizens present: Dorothy Burwell, since you have elected Frank Jones, please be sure you notify the Walworth County Land use and Resource department the next meeting is July 11 Chair Polzin, I have talked to Kilkenny on that. Burwell, be sure to put it on your calendar Old Business: None New Business: Reports/ Discussion/agenda preparation of issues resulting from monthly Committee Meetings: 1)Administrative Committee Liquor license Chuck Marsala, (Pat’s Place) Scoops taking over July 1st. and Maxi on renewal Bar tender Chief Mayer is you going to have an agenda item about the 600- hours work for part time employees. Chair Polzin, Do we have a policy in affect now that we are going to make…… Chief Mayer, that is state mandate, I was wrong at the meeting 600 hours and en employee is eligible for pension, then we may be required to pay 50% of their health insurance, if they elect to take it. Over 1000 hours it is 75% of their insurance we are required to pay. Part time and Part time on call, to keep that below 600 hours, we will set at 590 hours. Some of our part time employees in the past have exceeded 620 hours and are currently in the system, so there is no reason for them to work a maximum of 600 hours since we are already contributing to Wisconsin retirement fund. I believe there are 3-4 of those employees, and those employees that are already in the Wisconsin retirement system were not going to exceed 1000 hours so there would be no extra liability for paying their liability insurance. 2)Emergency Government -None 3)Finance Committee - None Fire & Rescue Committee: Clarification of billing paratech 50/50 split and 8% billing charges, has that be clarified or rectified, I know there was a check made supposed to have Chair Polzin sign. Chair Polzin stated he was not aware of this. There was a payment portion, which Herb was going to explain, there was a question of the 8% billing that of the 50/50 split with paratech, because the appearant company that does the billing for paratech they are affiliated, and there was some question that 8% the town would have to pay was applicable or not. Shari Wisnewski had attorney Wassel look in the contract and amend it because there was some question about when paratech also answers a call Paratech takes their percentage off the top. And we have to pay the percentage that goes to answer the call. So Sherrie and Steve were going to look into it to see if they had to amend the contract. Chair Polzin was looking into that and it is unfortunate that he is not here, why do we not table this part of the agenda here and if Herb gets here before the end of the meeting , if we have anything to add to it we can add to it.% what we pay paratech amend contract possible See Jan check approved for fire Chair Polzin, can have Herb make a report on that, Jim Wolfgram the consensus of the fire committee is we had a meeting last night, was that that should be paid, I guess there is a check already been generated for you to sign and send, that is what I heard at the committee level. Larry Lester was comfortable with it; actually everyone was comfortable about it except me for as much as I know about it, that it be paid. Chair Polzin, if that took place last night I have no paperwork that cam across my desk today. Clerk Bernsteen, said it could be on Jan’s desk 4)Lake Committee Table channel project waiting for participants Lake Committee estate Dorner electrical repairs $3000-5000 dollars thousand Frank, Is the dam non-functioning now? Kevin comments the dam operates manually and we have need to replace relay and control one electric motor on the big slide gate, that one we have to hand crank down it is not operating electrically, once the controls are replaced it need to be Calibrated, and that is beyond what we can do, we need the experts to come and do that. Frank Jones, how critical is, it is under manual control right? Does that create some problem in maintaining the lake level? Kevin, I would say yes, from the standpoint it is supposed to be electrically operated system and you are overriding that electrical system and have potential for further damage to the control and components. Frank Jones, would this fall into an emergency? Kevin, we don’t do that much damn gate adjustment, I would not consider it an emergency but at the same time I would not put off to fall. Jim Wolfgram, was the estimate going too directed to the DLSD or? Kevin, No it was coming directly to town. Better to have mechanical than manual 5)Park & Tourism Committee Gary De Vries horse shoe pits planned, he is conducting fishing seminar 1st & 2nd Saturday in June Chair Polzin, you have a bass tournament? Steve Schoff, the bass tournament is a park rental; they have rented the center for their tournament. It is for the cancer society, put on by Lennon Bus Service, this is their second year. Supervision Franzen, do we need to put anything on the agenda for the 4th of July or does that get done in committee? Gary De Vries 4th July pretty well set times are going to be celebration Elks food refreshments Bingo in the afternoon kids games Lauderdale ski team Chair Polzin is there any liability on our part. Steve Schoff, they furnish their own insurance with a certificate of insurance Chair Polzin fireworks also I had a telephone call and had steered them onto you and Kay, Is paperwork all in order, Kay has copies need to be signed by Chair. Chair Polzin took time to sign them at the meeting. Gary De Vries asked 4th July security direct traffic after fire works Kay comments park exit out of park is responsibility of park, then after that police takes over at the light. Chief will have walking patrols, and commented the park is responsible for getting people out of the part onto SS Dr., then the police department would take traffic at 50 and town hall. Chair Polzin, Can the police control the stop and go light Chief, we can, we have found in the past it is not a viable option to control the stop light, you have to big a stream of traffic, it is better to have officers to it manually. 6)Plan Commission Variance request for Thomas and Angela Good build 2 car garage 6045 bailey road Recomened by planning commission End Zone partial rezone, one lost is presently zoned b1 and to rezone to b2. Recommended to board to list of conditions what he wanted to do is open an exterior dinning area, committee attached several conditions to that. Committee made a motion for the board to approve forward on to county. Chair Polzin, what are the restrictions? 10X43’ for Bluegill Rd Jon Kasnick 7)Police Committee Chair Polzin all we is going to do is mentions Chief that by mandate you have to spend another $1000 of your $2000 allowance strictly for recorders because not you have to record….I do not believe there is any action on that so I think it is just a good time to mention it at this meeting. Chief $21,000 generator works still, needs parts to be put on by plumber. I have notified Dixie that the check will not be released until all work is done. Minor plumbing work, sent factory representative down, Tom the town Mechanic will have to be trained on the running of the generator and maintenance. The audio recorder is a State mandate that all felony and juveniles suspects have to be recorded by January 1st 2007. 8)Public Works Committee Engineering save agreement for 2007 road work, do mark can prepare the engineering service agreement for us. The committee today recommended sending on to the town board for approval. Appoint fence viewer, be one time deal that we have to view a fence, I have to have 2 people and I (Chair) am one of them, so we have to have another one for that. Recommendation from Public Works we have a bid for $1000 Burdicks for grading of 4 roads that are gravel grade them once 1 year. The recommend that we put 6” of on one of the roads and we feel that we do not have the authority to do that, it has not been a request from the subdivision. The have the agreement for grading, but do not for the roads. The four roads are Bennet, T-K, Babcock and Quiet Lanes. Guard rail 2003 sanitary hit bridge and needs $26500 name of insurance Company is Westbrook, and there was a whole file on it here, nothing was done with that, will turn it over to Wassel Law Offices because of the age of it, it’s 4 years old, It happened almost 4 year ago August 29 of 2003, But I think there is something we better look at that and find out what is going on, thanks to Jim Wolfgram brought that to our attention today. Jim I am going to ask if you would come over, all of the files that you had over there are down in the basement here, and was wondering if one day you have a chance if you would go down and pick it out of that file without going through every file. If you would we would appreciate it. Clerk Bernsteen stated that H=Jan and Herself would look and find the files. Chair Polzin, I don’t think we have to put that on the agenda either I think it is old, something we should turnover to attorney is that correct. Steve Harvey, you are basically looking for some sort of recommendation about possible action. Chair Polzin, how do we handle something that is 4 years old? And none of us were here at the time when it took place and with it some guidance on how to handle it. Supervisor Wolfgram just to clarify Westbrook was a engineer, they are a consultant engineer at the time did all the towns bridge inspections, after the incident they came out and re-inspect bridge, there were a couple cracks where the railing were, and they did a whole inspection of the bridge, found the approaches up to it and put together a whole report with pictures and what needed to be done was to bring the bridge and approaches up to conformance in other words the guard rail heights to eliminate the hazardous to make the bridge safe in that whole area. Was supposed to go for bid in the minutes and apparently never did. 9)ETZ Committees 10)Other Adjournment: Town Chair Wayne Polzin made a motion to adjourn the meeting with a second from Supervisor Jim Wolfgram and the motion carried unanimously.
