November 12, 2003 Minutes of Town Board Work Meeting

Minutes of Town Board Work Meeting of November 12, 2003.

The regular monthly Town Board Work meeting was held in the Town Hall
after due notice had been posted.
Chair Herman called the meeting to order at 7:00 p.m.

Audience:  Approximately  4 citizens

Chair Herman called roll and declared a quorum present for doing
business.

Communications:
None

Comments and suggestions by citizens present:
Dick Brown addressed the proposal of the purchase of the land
adjacent to town hall and stated he would like the board to consider
purchasing the entire corner.  Chair Herman stated that a new town
hall has been brought up before and the feeling that it was not
needed.  Herman added that the piece of property the Town is looking
at is approximately $ 42,000 versus $ 250,000 for entire property.  Ed
Brien stated that with the sewer line in the property being
considered, the building constructed would need to be a very narrow
building.  Chief Mayer stated this was just one site they were looking
at.  Ed Brien stated they could look at the lot next to fire station. 
Chief Mayer stated he anticipates that the Police Committee and the
Chair and Board will explore all options.  Dick Brown stated that if
the property was valued at $250,000 now, imagine what the cost would
be in ten years.  Ed Brien stated he hoped there would be a number of
meetings to discuss a potential site, total cost and building plans. 
Supervisor Fleming stated that the Police Committee meets on the 2nd
Mondays of each month.

Wayne Rowhel from the East Delavan Baptist Church was in the
audience. Chair Herman stated the Church was asking for a rezone on
their property from A-1 to P-2 to make a larger sanctuary to hold
their Sunday School in.  Herman added the Planning Commission would be
making that recommendation to the Town Board.

Chair Herman stated that he was under the impression that Jon
Anderson from Custom Competitions would be at the meeting tonite.

New Business:
Reports/discussion/agenda preparation from issues resulting from
monthly Committee meetings.
)aAdministrative Committee
Supervisor Fleming stated he had nothing for the agenda and Chair
Herman asked about the Liquor License for Bob’s Beach Shack.  Clerk
Endisch stated it was posted in the Newspaper this week and would need
to be on the Town Board Agenda for approval.

)bEconomic Growth and Development Committee
Supervisor Goetal reported that he will have another planning meeting
on Monday November 17.  Goethal explained they hadn’t announced a
co-chair or members of the committee yet.  Chair Herman stated that
Supervisor Hummel would be the co-chair of the committee.  Supervisor
Goethal stated that the three resident members would be Beth Peters,
Carol Coccia and Pat Morelli.  Goethal added the committee would be
meeting on the 3rd Monday of the month at Town Hall.

)cEmergency Government

)dFinance Committee
Covered in yesterdays meeting.

)eFire & Rescue Committee
Ed Brien stated that the truck the fire department is talking about
acquiring has a platform that sticks out in front and he doesn’t think
it will fit in the Town Hall Rd. Fire station.  Supervisor Hummel
stated it wouldn’t fit here, but would be stored at Linn Rd or one of
the bays at the Town Hall Rd. station could be added on to.

)fLake Committee
Supervisor Goethal reported that the Company that is going to do the
testing on the Mound Rd. project needs an Insurance Bond.  Chair
Herman stated he turned this over to the Town Attorney and Wassel
stated he would look in to.  Chair Herman asked if permit were ready
to go and Supervisor Goethal stated no permits were pulled yet.  Chair
Herman stated the process to obtain a permit can take up to five
months.

)gPark & Tourism Committee
Supervisor Malsch reported that Jon Anderson from Custom Competitions
has asked that he would like to hold the Triathalon on Sunday August 1
at Community Park.  Malsch stated he checked with the Fire Department
and they didn’t have any event scheduled for that day.  

Supervisor Malsch asked about the Fireworks, if the Park Committee or
the Fire Dept. would be in charge of.  Chair Herman asked who would
drive to Iowa to pickup, Chief Edwards has done that in the past. 
Supervisor Hummel stated he understands that Jerry picked up with his
own pickup truck.  Supervisor Malsch stated a decision needed to be
made in a timely manner as multiple discounts kick-in if you sign up
early and  sign for multiple years.  Supervisor Goethal stated he
would go for the multiple year contract, seeing we use the same
company each year anyway.  Supervisor Malsch indicated that he didn’t
think we had any requirement to hire a shooter.  Supervisor Hummel
stated that to be the shooter you needed to have a State Permit. 
Chair Herman and the other board members were in agreement that the
park committee should handle the fireworks.

Supervisor Malsch stated that the plumbing for the park is on order. 


Supervisor Malsch reported that Cory (CK Recreations) has had
multiple requests to rent the Community Center and he is unsure how
the town board wants to handle these requests.  Malsch questioned how
would the Evens be compensated, as they are outside their contract
period.

Cory Evan stated that he is willing to do the renting, setup,
cleanup, etc.  He has been putting people on hold, but has had
multiple requests i.e. the Elks, individuals and a church interested
in renting once a month.  Supervisor Fleming stated we should be
addressing this issue, in light of building a new community center
which would be open 12 months a year.  Supervisor Malsch stated then
we would have to have an annual contract with whoever was running the
park.  Malsch asked about fees for the park and Even explained they
would charge their normal fees and he would open the facility, setup
and clean for his normal % fees.  Even asked if he could push the
rentals and/or does he have to get permission from the board for each
case.  Chair Herman recommended that he touch base with Supervisor
Malsch pertaining to each rental.  Treasurer Wisniewski asked Attorney
Wassel if the minutes of this meeting would be the governing factor
over payment to the Evens for services provided.  Attorney Wassel said
the minutes would be sufficient.

Chair Herman asked the revenue generated from last years triathalon -
$ 748.00 for Services and a $ 350.00 donation to the little league. 
He asked Supervisor Malsch to let the board know if more services
would be needed.



)hPlan Commission
Chair Herman stated the Town Engineer is recommending the Town reduce
their letter of credit of 4D Development LLP (Dutch Meadows) to $
95,000.  Attorney Wassel stated the Gramses  are asking for a stop
action to be taken on Town’s lawsuit on the grounds that the counties
position is correct.
 
)iPolice Committee
Supervisor Fleming stated the Police Committee received two bids on a
new squad and Country Ford, Delavan was chosen with a bid of $ 22,598
for a 2004 Ford Crown Victoria.  Treasurer Wisniewski asked if this
price included the trade-in and Chief Mayer responded no.  Supervisor
Fleming stated they had received only one bid for the police boat. 
Harbor Recreation, Milton, WI bid $ 24,266 for a Safety Patrol Boat –
Crestliner Model 2000 with a Honda motor.  Chief Mayer stated the
Police Committee had asked Gage and Reed to bid and both chose not to.
 Supervisor Hummel asked about posting for bids in newspaper and
Attorney Wassel stated it wasn’t necessary because this was not a
capital expense.  

)jPublic Works Committee
Chair Herman stated he would be recommending on behalf of the Public
Works Committee to appoint Mark Adelman to the Public Works Committee
in lieu of Bob Militello who recently resigned.  

Chair Herman stated the Public Works Committee is recommending to
select as a Town 2004 road project resurfacing Mound Rd. from Hwy. 11
to CTH F. North, subject to a satisfactory agreement with the City of
Delavan.  An alternate choice would be Theater Rd. From S.R. 50 to
Bailey Rd.  Both alternatives would also include the repair of Town
Hall Rd. butt joint near Fire Station # 1.  Chair Herman explained
that the roads are normally selected in April but to qualify for
funding from LRIP (County), the paperwork needs to filed in November. 
Herman explained that we are going to change the way we spec the road
projects, the new way being a more accurate process. 

Chair Herman asked everyone to consider his memo regarding paying
foreman wages to the next senior person in the acting foreman’s
absence.  Herman gave some background on how the issue arose and
stated the board needs to come to some resolution.  Chair Herman asked
Mike Petkoff when he had his schedules available about work scheduled
for the next week and Petkoff answered on Friday.  After much
discussion Chair Herman came up the suggestion that when Lee Holden
could be moved up to the next level as operator, based on schooling
and experience he would then be eligible for foreman pay based on the
interpretation that had previously been placed in the union contract. 
Chair Herman stated he would address with employee.

Chair Herman asked Supervisor Fleming if he had heard anything about
the work rules grievance and Fleming stated he had not.  

)kETZ Committees
No Report

)lAll other recommendations.
)iChair Herman stated that with Christmas coming fast that he was
looking for input on how the town board felt about giving Christmas
presents to non-elected full-time employees.  Herman stated that he
recalls in the past six years that gift certificates to either North
Shore Bar & Grill or Joseph’s were given.  Supervisor Hummel stated he
thought we should patronize a different business each year. 
Supervisor Fleming agreed.  Supervisor Malsch stated he felt this was
a good idea because it showed the towns faith in their employees. 
Treasurer Wisniewski stated that in the past we gave certificates for
$ 25.  Chair Herman stated he would spread out the certificates with
multiple businesses.
)iiChair Herman gave an update on the presentation for “Smart Growth”
that Mike Cotter did for the Planning Commission.  Herman has spoken
with multiple sources about “Smart Growth” and is recommending the
town develop their own plan, instead of letting the county dictate. 
Herman asked the board if they would authorize him to speak with
Carolyn and ask her to give us an anticipated cost to do a plan for
Land Use and Housing Plan for the Town of Delavan.  Chair Herman will
contact her.

Supervisor Malsch made a motion to go into executive closed session
pursuant to Sec. 19.85 (1) (g) conferring with legal counsel re:
settlement of employment claims with a second from Supervisor Fleming
and the motion carried unanimously.
)aDiscussion/possible action concerning issues discussed.

Chair Herman made a motion to direct the town attorney to resolve
outstanding employment issues with Jim Wolfgram.  Chair Herman,
Supervisor Goethal and Supervisor Hummel voted in favor and
Supervisors Malsch and Fleming voted against.  The motion passed with
a 3 to 2 vote.

Supervisor Fleming made a motion to go out of Executive Closed
Session with a second from Supervisor Malsch and the motion carried
unanimously.

Supervisor Malsch made a motion to adjourn with a second from
Supervisor Fleming and the motion passed unanimously.

Chair Herman adjourned the meeting at 8:50 PM.
