Minutes of Town Board Work Meeting of September 13, 2006




The regular monthly Town Board Work meeting was held in the Town Hall
after due notice had been posted.

Chair John Pelletier called the meeting to order at 7:00 p.m.

Audience:  10 persons

Chair Pelletier declared that a quorum was present for doing
business.

Communications:
Chair Pelletier reported that the Wisconsin Towns Association has
asked the Town to host a section meeting on October 26, 2006 at 7 PM. 
The Town’s only responsibility is to arrange for a speaker to give a
1/2 hour presentation and provide refreshments.  Supervisor Nowak will
ask Fred Burkhardt from Walworth County if he would be available. 
Chair Pelletier will talk with Chief Mayer regarding using the Police
Department Training room for the meeting.  

Comments and Suggestions of citizens present:
Susan Vogus asked when the next meeting regarding Shodeen Development
is and Chair Pelletier responded September 26, 2006 7 PM at the
Community Center.

Emory Carlson asked what the speed limit on County Trunk F is.  He
said this has really become a speedway since the road has been
resurfaced.  He added there isn’t any posted speed limit and would
like to know where to go to see if could be posed.  It was determined
the speed limit is 55 mph and Chair Pelletier said the Town could work
with the county on getting signs posted.

Supervisor Polzin said that Ed Lindloff is complaining about County
Trunk O, once you go over I-43; same problem.

Emory Carlson reported that north of his farm; where the new
development is to be built, they have enough weeds for the entire
county.  He said they don’t mow, cut down weeds or anything else; he
asked if there is anything in the Town’s ordinance prohibiting this. 
Chair Pelletier responded only regarding the noxious weeds.  Attorney
Wassel said Carlson would have to work through the building inspector
regarding the noxious weeds.  Chair Pelletier said the development has
pulled the plug, the property and it is possible the property will be
for sale.  

Old Business:

New Business:
Chair Pelletier remarked he would like to deviate from the agenda and
asked Wassel if that was in order.  Attorney Wassel responded yes with
a motion.  Supervisor Polzin made a motion to deviate from the agenda
and discuss with items 2 and 7 first, with a second from Supervisor
Nowak and the motion carried unanimously.

a)Reports/ Discussion/agenda preparation of issues resulting from
monthly Committee Meetings

1.Administrative Committee
Supervisor Nowak asked for an agenda item for the approval of a Class
“B” and Class “C” license for Have Pig Will Travel- Randy Brown Agent.
 

Supervisor Nowak asked for an agenda item to approve the Assessor’s
Contract and then will send a copy to Keith for signature next week. 


Chair Pelletier asked Attorney Wassel why the Town has to pay for the
defense for the Town Assessor.  Attorney Wassel responded that if the
Assessor over assesses a property and the taxpayers asks to have their
monies refunded he doesn’t have to hire his own attorney.  He said the
assessor isn’t like the town attorney or the building inspectors, who
are both, required holding their own errors and omissions insurance. 
This is a part of doing business; not a liability issue.  

Supervisor Nowak reported that two bars in the town are going to be
closed and the committee is asking about sending a letter reminding
them about the ninety day non occupancy rule.  Clerk Endisch responded
that Shodeen has been in contact about Ralph’s and she will be working
with the new lessee regarding that license.  Attorney Wassel responded
that the town is under no obligation to inform the owners regarding
non-occupancy until the ninety days has past.  Treasurer Wisniewski
responded that has not been the precedent of the town; we do notify. 
Clerk Endisch will put together the notification and send to Attorney
Wassel’s office for approval.

Chair Pelletier asked there be an agenda item to budget for an
administrator for the 2007 budget and the potential to move funds for
this year.  This was out of a directive from the last Shodeen meeting.
 Supervisor Nowak said the administrative committee started to discuss
at their meeting,  but need to have some direction as to what the
board is looking for; someone with an urban planning degree, public
administration or an administrative coordinator.  Supervisor Polzin
said he thinks the person should have a minimum of five years of
experience.  Chair Pelletier stated we need to discuss the timing and
cost for this.  

2.Economic Growth & Development
Supervisor Endisch said the board initially approved an expenditure
to use of $ 1,950 from the tourism budget for the setup and printing
of the Town calendars.  The EGAD Committee is asking for board
approval to use $ 325 from the tourism budget to fund 500 additional
calendars.  Endisch said there are sufficient funds in the tourism
budget to cover.  Supervisor Nowak added the costs to setup and print
have exceeded the estimated costs from last year so based on the
amount collected from the ads 500 calendars could have been printed,
with no cost to the Town.  The EGAD Committee is asking for $ 325 from
Tourism Account to purchase an additional 500 calendars.   She added
this project was to be self-funded.  and the entire amount the town is
asking for funding the calendars is this $ 325; all else had been
funded by the selling of ads.  

This will be an agenda item giving the EGAD Committee authorization
to spend $ 325 from the Tourism Account to cover the additional
expense for the Town Calendars.

3.Emergency Government
	      Chair Pelletier said the committee had a training session; Jim
Hanson stated he needs no 		      budget.  Supervisor Malsch asked
about putting a generator for the police department as a 
             budget item for emergency government and Chair Pelletier
responded that should be added to 		      the police budget. 

4.Finance Committee
Chair Pelletier stated there are budget meetings scheduled every day
next week starting at 12:45 each day.  

Chair Pelletier asked for an agenda item to discuss the incorporation
of the Town.  Pelletier stated he has had one meeting about this; this
is a new effort to try to incorporate ourselves.  Pelletier estimates
the cost to be $ 70,000 to $ 100,000, but could cost more if opposed. 
Pelletier added the boundaries would be the same as proposed the last
time around; basically the properties in the Sanitary District. 
Pelletier stated he has met with the Sanitary District regarding this
issue and now during the budget time he is looking for the funds to
cover the cost.  

Supervisor Polzin suggested that the town should invite Senator
Kedzie to address where the Charter Towns Bill is; this will solve the
annexation issues.  Attorney Wassel stated that no one can predict
where legislation is going, if the monies are budgeted you just don’t
have to use your surplus and you are under no obligation to use the
budgeted amount.  

Chair Pelletier stated an agenda to fund incorporation should be
added to the agenda.  Chair Pelletier asked Attorney Wassel to lead
the discussion on this issue.  

Treasurer Wisniewski reported she spoke with Attorney Wassel
regarding the new definition on how room tax needs to be spent and we
are not doing it.  The $ 50,000 needs to be spent on tourism or we
need to eliminate.  Attorney Wassel said there are options on what can
be done; this should be an agenda item.  The component of paying down
on the debt service with the funds can no longer be done.    

5.Fire & Rescue Committee
		
Supervisor Polzin stated he would like to have a public hearing
regarding the burning ordinance.  The Committee still has a few
changes.  Clerk Endisch asked Attorney Wassel if this notice would
need to be published and Attorney Wassel stated there are no
requirements to do so, but he would recommend a class 1 notice with a
seven day lead time.  Supervisor Polzin said he would be providing the
town attorney a copy of the ordinance for his approval  

6.Lake Committee
	      Attorney Wassel asked for an agenda item for a closed session
to discuss the Hey lawsuit.

             Chair Pelletier asked if the town was allowed to
allocate borrowed monies across lake projects.
             Treasurer Wisniewski responded yes we can because the
borrowing was done with promissory 
              notes.  

7.Park & Tourism Committee
Supervisor Endisch reported that DNR approved the increased launch
fees and the fees were increased on August 25th.  The craft fair was
held and the attendance could have been better; the vendors are asking
if they could put up tent booths outside for next year and have food
available.  The committee will take these suggestions under
consideration.

Supervisor Endisch stated the Delavan Lake Yacht Club has asked to
hold a regatta on August 3, 2007 and use the Community Center.  This
Regatta would have over 100 boats in it; a Midwest competition. 
Endisch stated this is the day before the pig roast and he checked
with Chief Edwards and Edwards said this would be doable; they could
start setting up on Thursday to free up the Center to DLYC.  

8.Plan Commission
              Chair Pelletier stated he would like an agenda item to
approve a resolution to adopt the public
              participation procedures for the preparation of a
comprehensive plan.  Attorney Wassel will
              provide to the clerk.

Chair Pelletier stated the plan commission is recommending a rezone
for the Pearce Farm on Bailey & F along with a conditional use for
horse stables.  This should be an agenda item.  

Chair Pelletier announced the next plan commission for the Shodeen
project will be held on Tuesday September 26, 2006 at 7 PM at
Community Park.  


9.Police Committee
             Supervisor Malsch said nothing to report and no agenda
items.

10.Public Works Committee
Chair Pelletier asked for an agenda item to accept the public
improvements for the Dutch Meadows project based on the recommendation
of the town engineer.    

Chair Pelletier requested an agenda on recommendation of the public
works committee to hire an engineer to develop plans and engineering
specification for the salt shed for an amount not to exceed $ 3,500. 

	
Supervisor Polzin said we should be looking at a building which could
also house garages for the police department.  Supervisor Nowak said
this would be two different types of building.  Polzin said they could
have the same appearance; with a fire wall between them.  Treasurer
Wisniewski reminded the board that design build contracts in excess of
$ 15,000 are illegal.   Chair Pelletier will get an estimate from
Kopecky.   

Treasurer Wisniewski asked if the town should make payment to the
city in advance for Mound Rd.  It was determined she would make
payment; but later in the year.   

Chair Pelletier reported that the Public Works Committee discussed
replacing an additional truck; 5 Ton @ approximately $ 120,000.  The
committee decided this was a lot of money and decided that a one ton
truck would have better usage.  The truck could be used to plow the
subdivisions where a smaller truck is needed and would be able to have
a carry box for refuse from the chipper.  The cost of a one ton would
be approximately $ 60,000.  There are multiple options for payment
other than full payment.  Treasurer Wisniewski responded she would
rather pay for, since the money is there; it will be challenging to
pay for in future years.  She did say that if the town takes a loan
they can add to debt service and the town could budget for projected
debt service.  The committee is recommending buying a 2007 model
because the 2008 models use a different grade of fuel and oil. 
Pelletier asked for an agenda item to authorize the purchase of a one
ton truck for an amount not to exceed $ ???.  Mechanic Thiele will
provide the dollar amount.

12.Other
Chair Pelletier asked for an agenda item to reschedule the Town Board
Meeting to October 19, 2006; the town board will be at the Town’s
Association Convention on the normally scheduled night.

      Chair Pelletier made a motion to table subject’s b.) & c.) with
a second from Supervisor Malsch
       and the motion carried unanimously.

Adjournment:
Supervisor Malsch made a motion to adjourn the meeting with a second
from Supervisor Nowak and the motion carried unanimously.  

Chair Pelletier adjourned the meeting at 7:50   PM
